By accessing or using AppBird AI (the "Service"), operated by AppBird Technologies, Inc., a Delaware corporation ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
To access certain features of the Service, you must create an Account. When creating an Account, you agree to:
We reserve the right to suspend or disable Accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
Certain features of the Service require a paid Plan. By selecting, subscribing to, using, or continuing to use a paid Plan, the User agrees to pay all applicable fees, taxes, usage charges, add-ons, renewals, plan changes, and other amounts associated with the Plan.
Subscriptions renew automatically at the end of each billing cycle unless the User cancels before the renewal date. The renewal will be charged at the then-current price for the applicable Plan and billing frequency, subject to any notice required under Section 6.5.
The User may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period, and the User will retain access to paid features until that date. No prorated or partial refunds are issued for unused portions of a billing period, except where required by applicable law.
The Company may modify, rename, replace, discontinue, sunset, migrate, upgrade, downgrade, restructure, bundle, unbundle, or otherwise change any Plan at any time, including legacy, promotional, discounted, grandfathered, beta, free, trial, or custom Plans.
If a Plan is discontinued or materially changed, the Company may migrate the User to a successor, replacement, comparable, higher-tier, lower-tier, or otherwise commercially available Plan.
If such change results in a material pricing increase, the change will apply no earlier than the start of the next billing cycle after the applicable notice period, unless the User separately agrees otherwise, upgrades voluntarily, purchases an add-on, exceeds usage limits, or moves to a custom or enterprise arrangement.
The Company may change pricing, usage limits, feature access, API limits, credits, seat limits, billing frequency, and other commercial terms of any Plan from time to time. The Company will provide at least 14 days' prior notice of any material increase in recurring subscription pricing for an existing paid Plan. Unless otherwise stated, pricing changes apply from the next billing cycle after notice is provided. Changes to add-ons, usage-based charges, overage rates, promotional pricing, trials, beta access, and Plans not yet purchased by the User may take effect on shorter notice or immediately, to the extent permitted by applicable law.
Notice of any pricing, Plan, billing, usage-limit, API-limit, or other commercial change under this Section 6 may be provided by any reasonable method, including email, in-app notice, dashboard notice, billing portal notice, account page notice, top-of-page banner or stripe banner on the Service, posting on the Service, posting on the pricing page, posting on the Company website, notice posted in a shared Slack workspace, channel, or direct message used by the Company to communicate with the User or the User's organization, or updating the applicable checkout, invoice, order form, or subscription page.
The User is responsible for reviewing the pricing page, billing page, account page, and applicable notices before each renewal. Continued use of the Service after the effective date of a Plan, pricing, or billing change constitutes acceptance of the updated Plan, pricing, and billing terms.
By subscribing to a paid Plan, entering payment details, or continuing to use a paid Plan after a pricing or Plan change becomes effective, the User authorizes the Company and its third-party payment processors, including Stripe, to charge the User's payment method for recurring subscription fees, renewals, taxes, add-ons, usage-based charges, overage fees, upgrades, plan migrations, billing corrections, and other amounts due under these Terms.
Payments are processed by third-party payment processors, including Stripe. The Company does not store full credit card details on its servers. Payment processing may be subject to the processor's own terms and privacy policy.
All fees are exclusive of applicable taxes (including sales tax, VAT, and GST). The User is responsible for paying any taxes associated with use of the Service, except for taxes on the Company's net income.
All fees are non-refundable and non-cancellable except where required by applicable law or expressly agreed in writing by the Company. Billing disputes must be submitted to hello@appbird.ai within 14 days of the charge in question. Failure to dispute within that period waives the right to contest the charge, to the maximum extent permitted by law.
If a payment fails, the Company may retry the payment method, suspend or limit access, downgrade the Account, remove access to paid features, or terminate the subscription. The User remains responsible for all unpaid amounts, plus any applicable interest, collection costs, and reasonable attorneys' fees to the extent permitted by law.
Plans may include usage limits, seat limits, API limits, credits, or other restrictions. The Company may modify such limits from time to time. Exceeding limits may result in throttling, suspension, additional charges, required upgrade, or reduced access.
For signed-in Users, successful feed and archive requests share the daily Searches allowance shown for the applicable Plan. Each unique feed or archive request counts as one Search per account per UTC day. Repeating the same request, including reloading the same search, does not consume another Search that day. Each new batch of up to 50 apps counts as one Search, including batches requested through "Load more" or "Show all". These accounting rules apply to all Plans; a Plan with unlimited Searches retains no numerical Searches cap, subject to Section 6.13. Reaching a published quota does not, by itself, establish misuse.
Pro, Elite, Team, and Enterprise allow release-feed and date-based archive browsing across any historical date range. Each result set loads at most 30 matching release days on Pro, or 60 on Elite, Team, and Enterprise. Changing filters or dates starts a new result set, subject to the daily Searches allowance described above. Other paid Plans include the latest 30 UTC calendar days of release-feed and date-based archive browsing, with at most 30 matching release days per result set. Free and anonymous access remains limited to a 5-day preview. Older apps remain searchable by name when date filters are cleared and accessible through direct app links, subject to the Plan's other limits. Name searches retain the same result-set limit. Historical app metrics and version data remain subject to their existing feature entitlements.
This Fair Use provision applies to every Plan, including Elite, Team, Enterprise, free, trial, legacy, custom, and Plans described as "unlimited". Users may conduct ordinary interactive browsing and personal or internal business research consistent with their Plan, including temporary periods of higher activity. No Plan authorizes the prohibited conduct below unless the relevant activity is expressly permitted by the applicable Plan or a written agreement with the Company.
Fair use does not include:
In assessing fair use, the Company may consider the volume, frequency, duration, concurrency, level of automation, extraction patterns, infrastructure impact, applicable Plan allocations, and usage reasonably typical of Users on the same or a comparable Plan. No single factor is determinative, and a temporary usage spike alone will not ordinarily constitute a violation of this Section.
For fair-use issues other than unauthorized automation governed by Section 17, the following process applies. Where usage consistently or materially exceeds the level reasonably expected for the applicable Plan, the Company may contact the User to discuss reduced usage, an appropriate Plan upgrade, additional usage allocation, or another commercial arrangement. Unless immediate action is reasonably necessary to prevent abuse, security risk, service degradation, or an ongoing material violation of these Terms, the Company will provide notice and a reasonable opportunity to address the usage before applying restrictions. Any restriction will be reasonably proportionate to the relevant usage and may include throttling, limiting an affected feature, or temporarily suspending access until the issue is resolved. Any additional paid allocation or other commercial arrangement requires the User's agreement unless it is already provided for by the applicable Plan, checkout, invoice, or order form. If a material violation continues after notice and a reasonable opportunity to address it, or repeatedly occurs, the Company may suspend or terminate the Account in accordance with Section 17.
"Unlimited" applies only to the particular feature identified in the Plan and means that ordinary permitted use of that feature has no stated numerical cap. It does not remove other Plan limits or authorize prohibited extraction, unauthorized automation, redistribution, quota circumvention, or misuse. Purchasing a higher-tier Plan does not remove these restrictions.
Unless expressly agreed in writing by the Company, no User has any right to permanent grandfathered pricing, permanent feature access, permanent usage limits, or continued availability of any Plan. Any grandfathered, discounted, promotional, beta, or legacy access may be modified, discontinued, or migrated in accordance with these Terms.
The Company may offer free trials, promotional credits, beta access, discounted pricing, grandfathered terms, or other legacy or promotional arrangements at its discretion. If a trial converts to a paid subscription, the User will be charged the applicable Plan fee at the end of the trial period unless the User cancels before the trial expires. Trial eligibility is limited to one per User or organization unless the Company indicates otherwise.
Trial, promotional, discounted, beta, grandfathered, or legacy access does not create any right to continued access at the same price, features, limits, or duration. The Company may modify, limit, suspend, discontinue, or convert such access to a paid or successor Plan at any time in accordance with these Terms, with notice provided by any method permitted under Section 6.6 or Section 23.
If your Plan includes API access, you agree to the following:
Authorized use of the Company's official paid API and approved MCP integrations remains permitted within the applicable Plan or written agreement, documented functionality, credits, rate limits, quotas, and data-use restrictions. Sections 6.13, 9, and 10 do not prohibit automation or the downloading or caching necessary for that authorized use. This permission does not expand the agreed rights to reconstruct datasets, redistribute Content, or provide a substitute service.
You agree not to:
We reserve the right to investigate and take appropriate action against any violations, including suspension or termination of your Account and reporting to law enforcement where appropriate.
All Content available through the Service, including analytics, insights, rankings, screenshots, and app metadata, is the property of the Company or its licensors and is protected by intellectual property laws.
You agree not to:
Personal reference and internal business research are permitted in accordance with your Plan and these Terms, including authorized API and MCP use under Section 8. Uses beyond those expressly authorized require the Company's prior written approval.
The Service, including its design, source code, algorithms, analytics methodologies, visual elements, logos, trademarks, and branding, is owned by the Company and protected by copyright, trademark, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Company's trademarks, logos, or other proprietary materials. All rights not expressly granted herein are reserved by the Company.
You retain ownership of any User Content you submit to the Service (for example, feedback, tag suggestions, or other contributions). By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and incorporate that User Content for the purpose of operating, improving, and developing the Service.
You represent and warrant that you have all necessary rights, licenses, and permissions to submit User Content and to grant the license described above, and that your User Content does not infringe or violate any third party's rights.
The Service displays data sourced from third-party platforms, including the Apple App Store, Google Play Store, and other public and proprietary data sources. The Company is not affiliated with, endorsed by, or sponsored by Apple Inc., Google LLC, or any other third-party platform.
We do not guarantee the accuracy, completeness, or timeliness of third-party data. All third-party trademarks, logos, and brand names appearing on the Service are the property of their respective owners. Your use of any third-party services is subject to their respective terms and conditions.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.
THE CONTENT PROVIDED THROUGH THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, INVESTMENT, OR PROFESSIONAL ADVICE. YOU SHOULD NOT RELY SOLELY ON THE SERVICE WHEN MAKING BUSINESS OR INVESTMENT DECISIONS. ALWAYS SEEK INDEPENDENT PROFESSIONAL ADVICE WHERE APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO THE COMPANY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNTS TO THE COMPANY, OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD).
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY TO THE EXTENT THAT SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any User Content you submit to the Service.
We may suspend or terminate your Account and access to the Service at any time for cause, including but not limited to: violation of these Terms, abusive behavior, non-payment of fees, or fraudulent activity. We may also terminate your Account at our discretion with reasonable prior notice.
If we reasonably determine that you have used unauthorized automation, including bots, scripts, crawlers, scrapers, or automated browser tools to access or extract Content from the Service, we may immediately suspend or permanently terminate your Account and access, without prior notice, warning, or an opportunity to cure. No refund will be due for fees paid, unused subscription time, or unused credits, except where required by applicable law. This does not prohibit API, MCP, or other automated access expressly authorized by your Plan or by the Company in writing, provided it remains within that authorization and complies with these Terms. Any notice or other rights required by applicable law remain unaffected.
Upon termination: (a) your right to access and use the Service ceases immediately; (b) any outstanding fees become immediately due and payable; and (c) we may delete your Account data in accordance with our Privacy Policy.
Upon request made within 30 days of termination, we will make commercially reasonable efforts to provide you with an export of your Account data. After this 30-day period, we are under no obligation to retain or provide your data.
Sections of these Terms that by their nature should survive termination will survive, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Confidentiality.
If you believe that any content on the Service infringes your intellectual property rights, please contact us at hello@appbird.ai with a detailed description of the alleged infringement, including: (a) identification of the copyrighted work or intellectual property claimed to be infringed; (b) identification of the material on the Service that you believe is infringing; and (c) your contact information and a statement that you have a good faith belief that the use is not authorized. We will investigate all valid complaints and take appropriate action.
If you are a business User or participate in a beta program, you may receive access to non-public information about the Service, including but not limited to: unpublished features, beta functionality, pricing structures, technical documentation, and business plans ("Confidential Information").
You agree not to disclose, publish, or distribute any Confidential Information to any third party without the Company's prior written consent. This obligation survives termination of your Account and these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
Informal Resolution: Before initiating any formal dispute proceeding, you agree to first contact us at hello@appbird.ai and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If the dispute cannot be resolved informally, you and the Company agree to resolve it through final and binding individual arbitration, administered in accordance with the rules of a nationally recognized arbitration provider, seated in the State of Delaware. The arbitration shall be conducted in English.
Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Injunctive Relief: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemics, wars, terrorism, labor disputes, power failures, internet or telecommunications outages, cyberattacks, or third-party service provider failures.
The Company may assign or transfer these Terms, or any rights or obligations hereunder, in whole or in part, at any time without notice or your consent, including in connection with a merger, acquisition, corporate restructuring, or sale of assets. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. Any attempted assignment in violation of this section is void.
By using the Service and providing an email address, the User consents to receiving electronic communications from the Company, including account notifications, transactional emails, service updates, and legal notices.
The User agrees that legal, billing, subscription, Plan, pricing, product, and service notices may be provided electronically, including by email, in-app notice, dashboard notice, billing portal notice, account page notice, top-of-page banner or stripe banner on the Service, posting on the Service, posting on the pricing page, posting on the Company website, notice posted in a shared Slack workspace, channel, or direct message used by the Company to communicate with the User or the User's organization, or updating the applicable checkout, invoice, order form, or subscription page. Such notices satisfy any legal requirement that notice be in writing.
The Company may revise these Terms at its discretion by posting the revised version on the Service with an updated "Last updated" date. Revisions take effect when posted or on a later date specified by the Company, subject to applicable law and Section 6. Except where required by applicable law or Section 6, the Company has no obligation to provide separate, individual, or advance notice of revisions.
You are responsible for reviewing the current Terms. To the extent permitted by applicable law, continued use of the Service after revisions take effect constitutes acceptance. If you do not agree, you must stop using the Service. Where applicable law requires notice or consent, the Company will satisfy those requirements before applying the revisions to you.
Pricing, Plan, usage-limit, API-limit, billing, and other commercial changes are governed by Section 6 and may be communicated through any of the notice methods described in Section 6.6 or Section 23. The notice period and effective timing for such changes are governed by Section 6 rather than this Section 24.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Waiver: The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by the Company to be effective.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, and communications, whether written or oral, regarding the subject matter herein.
